Any individual accessing the Myjobo - www.myjobo.com website should carefully read these Terms and Conditions. If a user does not agree to these terms, they should refrain from using the website or providing any personal data. By continuing to use the website (Myjobo - www.myjobo.com), users confirm their agreement to be bound by these Terms and Conditions.

 

 

Registration and User Services

 

Myjobo provides services to registered users based on their type:

1.     Employer Registration: For users or organisations wishing to post job vacancies.

2.     Job Seeker Registration: For users seeking to apply for advertised vacancies.

 

The registration process is detailed on the website, and instructions are provided to ensure ease of use.

 

User Obligations

 

Employer Obligations

 

•             Only registered employers (companies, organisations, etc.) may post job vacancies on Myjobo.

•             Employers may only post vacancies for genuine, unfilled job positions within their organisations. Advertisements for remote or home-based work may be restricted at the discretion of Myjobo.

•             Employers are prohibited from posting job vacancies containing obscene, unethical, or inappropriate content. Such job vacancies will be removed without compensation.

•             By submitting a vacancy to the Myjobo, the Employer is authorising Myjobo to post such advertisement and submit job seekers ranked by Myjobo in accordance with the Employer's criteria (if any).

•             The Employer is responsible for the content of the vacancy and will indemnify Myjobo against any claim, loss, liability, expense and/or damage (\Losses\) in connection therewith.

•             The Employer shall include in the job description the following information:

o  Any qualifications and/or authorisations required by law or any or by any relevant professional body

o  The job nature of the work, the location, minimum experience, training and/or qualifications required

•             Free job postings under Promotional Offers are assigned to the employer as a whole—be it a company, firm, or organization—rather than to individual users or business units. Franchised businesses receive free job postings centrally, to be shared among franchisees, rather than allocated to each franchise operation.

•             Free job postings under Promotional Offers are at the discretion of Myjobo. Any breach of these Terms by the employer may lead to the withdrawal of Promotional Offers Services. Additionally, if the employer has any outstanding debt to Myjobo, the Promotional Offers Services will be withdrawn.

•             Employers must comply with the laws of the Republic of Malawi and ethical standards in their job postings.

•             Employers may not request sensitive personal data from Job seekers, including:

o  Political or religious beliefs.

o  Trade union membership.

o  Health, biometric, or genetic information.

o  Information on sex life or sexual orientation.


•             CV search access can only be used for recruitment purposes. Employers shall not share its access to CV Search with any third party. Using CV Search for the purposes of marketing or direct selling to Job seekers is prohibited and will result in the suspension of the account. The Client shall not use any automated computer program to search for and/or download information on Job seekers.

•             All and any subsequent dealings between the Employer and any applicant in connection with the applicant's response to the job posting are the responsibility of the Employer, and Myjobo accepts no liability whatsoever therewith. The Employer will indemnify Myjobo against any Losses in connection therewith.

•             The Employer shall not resell any Services without the express written permission of Myjobo. Myjobo reserves the right to impose any restrictions it deems fit should it provide permission for the reselling of any of the Services.

•             Employers found in violation of these obligations may have their accounts deactivated, and Myjobo reserves the right to deny future registrations or access.

•             Myjobo reserves the right in its sole and absolute discretion to remove any vacancy at any time without reason. Examples of vacancies that may be removed include, but are not limited to:

o  those that Myjobo considers illegal, inappropriate, or fraudulent

o  those that directly or indirectly require or ask for application or registration fees

o  those that advertise, pyramid, network marketing or get-rich-quick schemes

o  those that have been indiscriminately posted or duplicated across multiple sectors

o  those that advertise websites, services, businesses, business opportunities and/or contact details

•             The Employer agrees to use the Myjobo and the Services in 'good faith' i.e. to post authentic, impartial, and unique jobs of reasonable quality, which provide both adequate and accurate job details. The Employer also agrees that any abuse of the Services, Website or these Terms and Conditions can result in the Employer's access to the Services being removed, and its account terminated.

•             For the sake of clarity and the avoidance of doubt, the employer acknowledges that it is acting as a data controller for the purpose of current data protection legislation in connection with any personal data it obtains in the provision of the Services by Myjobo. It is the employer's responsibility to comply with its obligations as a data controller and to satisfy themselves of the legal grounds for processing any personal data.

•             It is the Employer's responsibility to protect their computers against any viruses and malware.

 

Job Seeker Obligations

 

·        Job seekers may only create one profile and must not share their login credentials with others.

·        Job seekers must be at least 16 years old to register and must provide accurate, truthful, and complete information.

·        Job seekers agree to update their profiles promptly if their information changes.

·        Job seekers must comply with laws of the Republic of Malawi and refrain from posting or sharing any offensive, defamatory, false, or illegal content, including but not limited to:

o   Pornographic materials or nude photographs.

o   Content that incites criminal activity or discrimination.

o   Copyright-protected materials without appropriate permissions.

 

 

Obligations of Myjobo


•             Myjobo is committed to safeguarding users’ personal data in compliance with the Republic of Malawi’s and international data protection laws.

•             Myjobo reserves the right to edit or remove content posted by users if it violates these Terms and Conditions.

•             Myjobo shall provide the Services in accordance with these Terms. Employers must set up an account with Myjobo to gain access to the Services. The Services do not constitute an offer by Myjobo, and Myjobo reserves the right in its sole and absolute discretion to refuse to offer the Services to any person or organisation.

•             Without prejudice to any other remedy, Myjobo may terminate the Employer's account and any or all contracts and Services with immediate effect in the event of material or persistent breach of these Terms by the Employer or if Myjobo has reasonable grounds to believe that the Employer cannot or will not pay its debts.

 

•             Myjobo cannot guarantee that (i) the Website and/or the Services will be available at all times; and (ii) the Website will be free from errors, viruses and/or other harmful applications. For the avoidance of doubt, no Service is guaranteed to result in a placement.

•             Myjobo acknowledges that it will act as a data controller for the purposes of existing data protection laws and regulations and that it will comply with its legal obligations in the provision of the Services.

•             Myjobo shall not be in breach of these Terms if events beyond its reasonable control prevent Myjobo from performing the Services.

•             Myjobo provides users with the ability to submit complaints or suggestions about the platform by contacting: complaints@myjobo.com .

 

Payments

 

Myjobo offers both free and paid services. Payments are made to Enviro Future Limited in the methods listed below:

1.     Cash Payments: Available through designated locations or agents.

2.     Bank Transfers: Instructions provided on request.

3.     Mobile Money: Airtel Money or Mpamba.

4.     Card Payments: Visa, MasterCard, American Express etc

5.     Stripe, PayPal, for now.

 

Invoices and receipts are provided upon request. All payment transactions comply with the Republic of Malawi’s financial regulations.

 

Copyright

 

All materials, including content, design, images, and source code, available on Myjobo are the exclusive property of Enviro Future Limited or any third party from whom such rights are licensed. An individual or entity shall not reproduce, copy, modify, adapt, publish, transmit, distribute or in any way commercially exploit any material which is subject to any such intellectual property rights.

 

All intellectual property rights connected with the Services and/or the Website shall remain vested in Enviro Future Limited or any third party from whom such rights are licensed. The Employer shall not reproduce, copy, modify, adapt, publish, transmit, distribute or in any way commercially exploit any material which is subject to any such intellectual property rights.

 

 

Changes to Terms and Conditions

 

Myjobo reserves the right to amend these Terms and Conditions and fees at any time, provided that no change shall be retrospective. Updates will be posted on the website and will take effect immediately. Users are encouraged to review the Terms and Conditions periodically to ensure compliance.

 

If any clause or part of a clause is held to be invalid or unenforceable, this will not affect the validity or enforceability of the remaining clauses or parts.

 

Myjobo shall not be in breach of these Terms and Conditions if events beyond its reasonable control prevent Myjobo from performing the Services.

 

Dispute Resolution and Applicable Law

 

All disputes between Myjobo users and Enviro Future Limited will be resolved amicably. If a resolution cannot be reached, disputes will be referred to the courts in Lilongwe, Malawi, and resolved under laws of the Republic of Malawi.
